Return & Exchange

Policy:
If you are not satisfied with your purchase due to default in production, you can return the products within 7 days after receiving it.
Items shall be returned hereunder properly wrapped and packed in their original packaging in unused and saleable condition – for sealed items, e.g. shorts or panties, with the seal unbroken.
In case of a return or exchange the risk (for loss or damage during delivery) is on the customer.

Defective or damaged items:
In case you find that an item delivered by us to you is defective you should contact Customer Service as soon as possible with a formal complaint, to get a replacement delivery or, if that is not possible, a refund. The same applies in case you identify that a product has been damaged during transportation or you identify other deviations in the delivery, e.g. that the number of items or the product model delivered is not in line with your order.

Sale Return:
Sale items cannot be exchanged or returned at any time.

Return at physical Tanoli Stores:
Items purchased at the Webshop cannot be returned in or through any physical Tanoli Stores.

Refund:
As soon as we have received the returned items, and have been able to confirm that the requirements above are met, we will refund your payment within 30 days after we have received the returned product.

Exchange:
We do not offer exchanges, only refunds, simply return your original order for a full refund excluding the shipping charges and place a new order.

Please be advised that customs charges and/or import duties are determined by the customs office of the regarding destination and where applicable, may be levied once the parcel arrives at the destination country.
Payment of these charges and taxes is the responsibility of the recipient and will not be covered by Tanoli. For further details of charges, please contact your local customs office.

Article 1: Definitions

Customer

The vendor’s other party to the contract, who is a consumer, being a natural person and not a professional or business party, to whom the vendor sells and delivers

Article 2: Scope of Application

2.1       These general terms and conditions are applicable to all offers by vendor and to all contracts between vendor and customer.

2.2       The text of these terms and conditions are available to the customer, before the contract is concluded. In case it is not possible to make the general terms and conditions available as described before, the vendor will make sure that the general terms and conditions are available to the customer in a easily accessible and free of charge way.

2.3       Deviations from these general terms and conditions are only valid if expressly agreed upon in writing.

2.4       The vendor has the right to amend these general terms and conditions from time to time without prior notice. The version applicable to an agreement/order, is the one available on the website at the time the agreement is entered into.

 

Article 3: Offer

3.1.      If an offer has a limited validity or is subject to special conditions, this will be stated explicitly in the offer.

3.2.      The offer contains a complete and accurate description of the products and/or services. The description is sufficiently detailed to unable a proper assessment of the offer by the customer . If the vendor uses images, these are a mere reflection of the products and/or services. Mistakes or errors in the offer shall not be binding to  the vendor.

3.3       All offers will contain such information that it’s clear to the customer which rights and obligations are involved while accepting the offer.

 

Article 4: The agreement

4.1       The webshop is intended for sales to consumers only. Customers below the age of 16 must gain parental approval before submitting any order through the webshop.

4.2       A binding purchase agreement is concluded with the order confirmation of vendor. Until the receipt of the confirmation, the customer is entitled to cancel the agreement.

4.3       If the contract is concluded electronically, the vendor will take appropriate technical and organizational measures to secure the electronic transfer of data and will ensure a secure web environment. If the customer pays electronically, the vendor will take appropriate security measures.

4.4       Vendor reserves the right to cancel an order if fraud or similar activity, such as unauthorized use of another´s credit card, is suspected.

 

Article 5: Right of cancellation

5.1       During 7 days after receiving the products, the customer has the right to cancel the agreement. If customer wishes to make such a return, the return instructions of vendor must be followed.

5.2       During this period the customer shall carefully handle the product and its packaging. He will only unpack or use the product to the extent necessary in order to assess whether he wishes to keep the product. If he exercises his right of cancellation, he will return the product to the vendor in its -if reasonably possible- original condition and original packaging, according to the reasonable and clear instructions provided by the vendor.

 

Article 6: Costs of cancellation

6.1       If the customer exercises his right of cancellation, the costs of return will be for his / her own account.

6.2       If the customer has paid an amount, the vendor will refund this amount as soon as possible, but no later than 30 days after the cancellation and the correct returning of the goods.

 

Article 7: Exclusion of the right of cancellation

7.1       The vendor may exclude the right of cancellation provided for in article 6. The exclusion is valid if mentioned by vendor in the offer, or before closing the agreement and in the circumstances as mentioned in article 7.2.

7.2       The right of cancellation is excluded in the following circumstances:

  1. products created by vendor on specifications from customer (costume- made);
  2. products that are clearly personal in nature;
  3. products that cannot be returned because of their nature;
  4. products that are not saleable;
  5. when the right of cancellation is misused by customer or it is not reasonable for the vendor

to accept to take back the product under the given circumstances.

 

Article 8: Prices and costs

8.1        The prices at the webshop are current prices and may be changed at any time.

8.2       The vendor is not bound by price indications in the webshop which the buyer must reasonably or apparently understand are incorrect and which, for example, have occurred due to technical problems in the web platform or rates that have been manipulated by the customer.

8.3       Prices are inclusive of local VAT and are payable in the currency indicated at the web shop. For non-EU customers, additional VAT, customs charges and other levies may be incurred by the local Customs Authority on the import of the products, at applicable rates.

8.3       Price increases within 3 months after the conclusion of the agreement are only allowed if they are the result of regulations or stipulations by law. If the vendor decides to increase the prices, the customer will be authorized to dissolve the contract unless the right to raise the price is provided for by law.

 

Article 9: Promotions and Discount codes

9.1       All campaigns with reduced prices are limited in time. Multiple offers can normally not be combined. A discount code or voucher is only valid once per customer and purchase. In case of obvious misuse of offers, such as coupons and promotion codes, the web shop reserves the right to cancel the order in question.

9.2       On orders eligible for a gift or discount the value of the gift/discount is considered as a general discount on the total amount of the order. If part of or the entire order is sent back for exchange or refund the value of the returned merchandise is recalculated and the purchase price minus the relative share of the overall discount will only be credited.

9.3       Promotions and discount codes are only valid on new orders and cannot be applied retrospectively.

 

Article 10: Payment

10.1      Payment can be made by credit card, direct debit invoice or as may otherwise be instructed at the webshop. Where payment is subject to validation and/or authorization by a card issuer or bank or to credit validation, any order confirmation is subject to such validation or authorization. We co-operate with an authorized payment service provider, who processes your personal details in accordance with the international security standard PCI DSS, developed by international credit card companies such as VISA, MasterCard and Diners. All transactions will be sent through SSL (Secure Sockets Layer) in encrypted form and all card details and payment information will be protected and processed with a high level of security.

10.2      Unless otherwise agreed, prices are to be paid by the customer within 7 days after the start of the cancellation period as referred to in article 5.1.

10.3      The customer is obliged to rectify promptly any inaccuracies in data provided to the vendor.

10.4      Subject to a limitation by law, vendor has the right to charge customer reasonable costs in case customer fails to pay the amount due.

 

Article 11: Compliance and warranty

The vendor guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and legal provisions and/or government regulations existing on the date of the conclusion of the agreement.

 

Article 12: Delivery and execution

12.1      The vendor will take the greatest possible care when receiving and implementing orders for products and when assessing applications for the provision of services.

12.2      The place of delivery is the address provided by the customer.

12.3      We always aim at delivering your order as soon as possible. Normally orders of items in stock ship within 1-2 business days from order confirmation and can be expected to be delivered to the customer within five to ten business days. Delivery times are estimates only and particularly during high season (e.g. Christmas) deliveries may take longer than normal. In case of a delay in delivery of more than fifteen (15) business days beyond the estimated delivery time above, the customer may cancel the order subject to written notice to vendor, in which case vendor will, as vendor’s entire liability for the delay, credit any payment made by customer.

12.4      In case of termination in accordance with article 12.3, the vendor will refund the customer the amount already paid as soon as possible, but in any case not later than 30 days after the termination.

12.5      On rare occasions a certain product may run out of stock. If the missing item will not be replenished, the customer will be notified as soon as possible. Vendor may propose an alternative product or – if that is not possible or if such alternative product is rejected – may have to cancel part of or the entire order. The vendor is responsible for the costs of returning.

12.6      The risk of damage and/or loss of products rests with the vendor until  the moment of delivery to the customer, unless otherwise agreed.

 

Article 13: Complaints

13.1      Complaints should be submitted to the vendor within reasonable time, fully and clearly describing the shortcomings  and further in accordance with vendor’s complaints policy.

13.2      The vendor will deal with the complaint within 7 days after receiving it. In case the complaint can not be solved after mutual deliberation, the customer may submit the complaint to the competent court of law.

 

Article 14: Applicable law and disputes

14.1      All agreements between vendor and customer and these general terms and conditions are subject to Dutch law. The Dutch court has jurisdiction for any dispute that should arise between the vendor and customer .

14.2      All disputes which arise between the contractor and the client, will be submitted to a competent court in Rotterdam.

 

Article 15: Final Provision

15.1      The supplier is entitled to change these terms and conditions unilaterally. The most recently filed version of  the terms and conditions always apply.

15.2      In case one or more provisions of these general terms and conditions prove to be null and void or destroyed, the remainder of these terms and conditions remain in position. The invalid provision shall be replaced by a valid provision to the content, scope and effect of which will match as closely as possible the invalid provision.

By submitting an order at the Web Shop you consent to us processing your personal data. Your purchase may involve the collection and processing by us, or by a sub-contractor of us, of your personal data, for example of the data you fill out in the order form, including your civic registration number as the case may be, or the personal data processing that may be necessary to execute your payment.
